FAMILY

Divorce

  • We can act for you if you are a Petitioner – the person issuing the proceedings or if you are a Respondent – the person receiving the divorce proceedings or if you are a Co Respondent – the person named as the third party in an Adultery Petition

  • We offer fixed fees for simple undefended divorces

  • Depending on your income and capital position the court may grant you a waiver so that you do not have to pay any fee at all to issue the Divorce or a partial waiver so that you only have to pay some of it

 

Children

  • We can act for you if you are a Parent or any other Carer or a Relative – whether you are the person issuing the proceedings or if you are a Respondent – the person receiving the proceedings

  • We offer fixed fees for many aspects of the work that we do in Children matters

  • Depending on your income and capital position the court may grant you a waiver so that you do not have to pay any court fees at all or you may be eligible for Legal Aid in certain circumstances to assist with legal costs and court fees

 

Care Proceedings and Child Protection

  • We can help you if you are a Parent or any other Carer or a Relative – whether you Social Services have issued court proceedings or prior to that if you are still in meetings with Social Services about your children either on a Child Protection Plan or at a Pre Issue meeting

  • Legal Aid is available if you are a Parent; we can offer fixed fees for other Carers/Relatives for some aspects of the work

 

Separation

  • We can help you if you are separating from your partner and are not married and need to arrange a financial settlement or make arrangements for your children

  • If an agreement is not possible then we can also help you deal with matters if court proceedings become necessary

  • We can also help if you are separating from your husband, wife or civil partner and want to arrange a financial settlement on an interim basis prior to formally bringing your relationship to an end by way of Divorce or Dissolution

 

Injunctions and Domestic Abuse

  • We can act for you whether you are the person issuing the proceedings or if you are a Respondent – the person receiving the proceedings

  • We offer fixed fees for many aspects of the work that we do in Injunction matters

  • Depending on your income and capital position you may be eligible for Legal Aid in certain circumstances to assist with legal costs

  • The court does not charge a fee to issue the application for non-molestation injunctions or occupation orders

 

Financial Settlement

  • If you have reached an agreement with your partner or spouse and want to enter into a formal written agreement we can help

  • Even if you are not at the stage where you have reached an agreement we can help you negotiate with your partner or spouse or their solicitor to reach agreed terms

Financial Court Proceedings

  • If it has not been possible to reach an agreement with your partner or spouse or civil partner in relation to financial matters then we can help you apply to the court for matters to be resolved by a Judge

  • Even if court proceedings are issued it is always possible and indeed expected to keep settlement in mind and try and seek to agree on matters. Court proceedings and contested litigation are very expensive and the fees can if pursued to the bitter end sometimes outweigh the value of the assets that are in dispute

  • If you can’t reach an agreement Family Arbitration is another option that results in a binding settlement but is quicker and more cost-effective than court

 

Statutory Declarations

  • We can prepare Statutory Declarations for you should you require them

  • Usually, these are required for such events as a Change of Name, a Marriage overseas, or an application for Student Finance

  • We offer these services on a fixed fee basis

 

Pre Nuptial and Post Nuptial Settlements

  • Pre Nuptial Settlements are formal agreements entered into by a couple before a marriage or civil partnership

  • They are designed to protect pre-existing assets from falling into the pot to be shared by the parties on a divorce or dissolution

  • Whilst they are not binding in English Law as such a Judge in any future dispute will carefully look at the terms of any settlement when considering the division of the assets on a divorce or dissolution
