Making a School Child Abuse Claim
Whenever there has been child abuse by a teacher or other members of staff in a school, it is possible to bring a case against the individual involved provided the matter has been reported to the police. If the person who committed the abuse was an employee of the school, you can also sue their employer – whether that is a private or a state school. The local authority is usually responsible for state-funded schools, whilst the responsibility in a private school lies with the owner or its governors.
If it can be demonstrated that the school knew about the abuse – or should have known about it – and failed to act, the organisation can also be liable for its negligence. For example, if an abuser had a criminal record for similar offences before being employed by the school, or if a child told a teacher about the abuse and the adult did nothing about it. Making a compensation claim against an organisation in this way is often the best course of action as they will be insured against claims brought against them – and those responsible will be brought to justice.
Claims against schools in the civil courts can be very difficult indeed to win. If your case has not been the subject of a recent successful prosecution against a teacher or some other member of the school staff in the criminal courts, then we are not going to be able to take on your claim.
